Izinguquko Ezinkulu Emahoreni Omsebenzi Ziza eNingizimu Afrika

UNgqongqoshe Wezokuqashwa Nomsebenzi, Nomakhosazana Meth, ushicilele uchungechunge lweziBill ezintsha ukuze zithole imibono yomphakathi. Lezi zinguquko zingaletha ushintsho olubalulekile emahoreni okusebenza kanye nohlelo lwekhefu labazali.

Imibhalo evezwe ifaka phakathi i-Labour Laws Amendment Bill, 2025, i-Labour Relations Amendment Bill, kanye ne-Labour Relations Amendment Bill, 2025 kanye nezaziso ezihlobene nazo. Lezi zinguquko zihlose ukubuyekeza nokwenza ngcono imithetho ebalulekile yezabasebenzi eNingizimu Afrika.

Imithetho Ethintekayo

Izichibiyelo zithinta le mithetho elandelayo:

  • Basic Conditions of Employment Act, 1997 (BCEA)
  • Employment Equity Act, 1998 (EEA)
  • National Minimum Wage Act, 2018 (NMWA)

UMnyango uveze ukuthi lezi zinguquko ziyisinyathelo esibalulekile ekuqiniseni amalungelo abasebenzi ezweni lonke. Umphakathi unikezwe ithuba lokuletha imibono kuze kube ngu-26 Mashi 2026.

Ngokusho komnyango, izinguquko zihlose ukuvuselela imithetho yezabasebenzi, ukuqinisa ukuphepha komsebenzi, ukukhuthaza ukulingana, kanye nokwandisa amalungelo kulabo abasebenzi ababekade bengabhekwa ngokugcwele.

Ukuvikelwa Kwabasebenzi Abasebenza Ngama-“On-Call” Nezinkontileka Eziguquguqukayo

Isigaba esisha 9B ngaphansi kwe-BCEA siletha ukuvikelwa kubasebenzi abasebenza ngama-“on-call”, izinkontileka ze-zero-hours, noma ezaziwa ngokuthi ama-min-max contracts.

Lezi zinhlobo zomsebenzi zivame ukutholakala ezimbonini ezifana nokuthengisa, ezokuphepha, kanye nezokwamukela izivakashi (hospitality). Abasebenzi kule mikhakha bavame ukubhekana namahora angazinzile, ukungabi nemali eqinisekisiwe, kanye nokukhanselwa kwemisebenzi ngomzuzu wokugcina.

Izidingo Ezintsha Zabaqashi

Ngaphansi kwezichibiyelo ezintsha, abaqashi kuzofanele:

  • Bachaze ngokubhala amahora aqinisekisiwe kanye namahora aphezulu avunyelwe
  • Bacacise izikhathi zokutholakala komsebenzi
  • Babeke isikhathi esifanele sesaziso sokubika noma sokukhansela ishifthi

Uma umsebenzi ukhanselwa ngaphandle kwesaziso esanele, umqashi uzophoqeleka ukukhokhela lowo msebenzi njengokungathi usebenzile.

Isikhathi sesaziso kumele sicabangele uhlobo lwebhizinisi, izinga lokulawulwa komsebenzi ngumqashi, kanye nomthelela kulokho empilweni yomsebenzi.

Ukwenyuswa Kwesinxephezelo Sokudilizwa (Severance Pay)

Izichibiyelo ziphinde zenyuse isinxephezelo esisemthethweni sokudilizwa emsebenzini kusukela evikini elilodwa ukuya kumaviki amabili omholo ngonyaka ngamunye womsebenzi oqediwe, ikakhulukazi lapho kudilizwa ngenxa yezidingo zokusebenza kwebhizinisi.

Lezi zinyanga ezine nezinsuku eziyishumi zingahlelwa ngokuvumelana phakathi kwabazali, noma zabiwe ngokulinganayo uma kungabikho sivumelwano, kodwa kuqala kunikezwe umama ozalayo.

Ukuvulwa kwenqubo yokuphawula komphakathi kuze kube ngu-26 Mashi 2026 kunikeza izakhamuzi ithuba lokuba yingxenye yokwakhiwa komthetho ozothinta ikusasa lomsebenzi ezweni.
